The three judges presiding over the Nóos corruption trial in Palma de Mallorca have declared that Infanta Cristina will have to face two charges of tax fraud, as they feel the Bótin doctrine does not apply to her as they believe her to have been a “necessary cooperator” in the alleged crime.

Infanta Cristina will now return to court on February 9 with the other 17 defendants in the case, including her husband Iñaki Urdangarín, when the defendants are required to begin taking the stand.

Infanta Cristina arrives at court in Palma de Mallorca earlier this month Her lawyers had appealed for the Bótin doctrine to be applied to her case as the state prosecutor did not believe she had been apart of the tax crimes. Charges were brought on the recommendation of an investigating judge following up evidence presented by a private group. The Infanta is the first member of the Spanish Royal Family to face criminal charges. All about the Nóos trial can be found here.
